This article examines the intersection between Law and Artificial Intelligence (AI), analyzing the impacts of new regulations in situations in which they are applied. The study highlights the Brazilian example, investigating existing legislative proposals, and compares them with European Union (EU) regulatory initiatives. The qualitative and exploratory research is based on national and international normative documents, revealing the need to adapt legal texts to the constant improvement of technology. The work reaches the conclusion in the sense that clear and pragmatic rules that reconcile innovation with the protection of fundamental rights are essential.
